INTERNATIONAL LAW FINAL TAKE-HOME
EVALUATION
Submission: You need to hand in this
evaluation personally on March 31, 2009 at 1.00 pm IN CLASS, followed by an
email to me. Early submission: If
you hand in this evaluation personally IN CLASS on March 19, 2009 at 1.00 pm followed
by an email, you will earn 4 bonus points. If you hand it in on March 24, 2009
at 1.00 pm IN CLASS, followed by an email, you will earn one bonus point in
this evaluation. Please sign the submission sheet so that there will be no problem
with the bonus points.
There are no
other submission dates or places. For further clarification, this evaluation
may NOT be returned only by email, left in my mailbox, office, or given to the
faculty secretaries. If this evaluation is not submitted as required, it will NOT
be marked.
Please note that
I will not be able to grant extensions. The maximum page limit is 8
double-spaced pages for the whole test. In all answers, you need to examine
each topic in light of the theoretical framework discussed throughout the course,
and use the required readings, class activities, and class discussions as
examples to support your answers.
Evaluation criteria: The criteria are formulated in the form of questions.
A positive response must be given to the following questions in order to obtain
full credit for each answer. The value of the evaluation criteria is as stated
after each question. The total value for
questions 1 and 3 is 10 points each and 5 points for question 2.
- Did you answer the question comprehensively? Are all
relevant problems discussed? Was the answer readable and well organized?
Did you make connections between issues discussed in your answer? Did your
answer show an understanding of the topic dealt with? Value of this criterion: 2.25 points for questions 1 and 3, and 1.5
points for question 2.
- Did your answer discuss problems by reference to
theoretical issues learned during the course? Did your answer show an
understanding of appropriate readings? Did your answer make reference to
and elaborate upon the required readings? Value of
this criterion: 2.25 points for questions 1 and 3, and 1 point for
question 2.
- Did your answer show an understanding of the discussions
and issues arisen in class? Did your answer make reference to and
elaborate upon class discussions and activities? Value of
this criterion: 2.25 points for questions 1 and 3, and 1 point for
question 2.
- Is there a critical personal assessment of the topic
discussed? Does the personal assessment show some originality? Value of this criterion: 2.25 points for questions 1 and 3, and 1
point for question 2.
- Did your answer show an exceptional analysis of the
topic discussed? Value of this criterion: 1 point
for questions 1 and 3, and 0.5 point for question 2.
- Analyze
the scene about the international contract shown in class. Examine all
aspects of Private International Law that apply to the breach of contract.
- Choose
one of the learning outcomes for this course from the course syllabus.
Show me how well you have achieved this learning outcome. You are free to
choose the type and format of evidence you want in order to prove your
learning and its quality. For example, you may include evidence of your
best work, you may write a reflective journal entry, analyze a legal
problem, or write a case and offer a solution. You may, of course, use any
combination of these possibilities, or even something else. But remember,
I will not be assessing the selected work itself, or paper, or journal, or
whatever else you may want to supply. What I will be looking at is whether
and how well you have achieved –and can perform with respect to- the
selected learning outcome. The only limitation is that the selected
evidence must be included on the sheet of paper you submit and must be submitted
by email together with the answers to all other questions.

following scenario. If you need
to conduct research of a foreign legal source, please explain the steps
you take.

Pierre
and Paul, two Canadian male teachers aged 35 and 40 respectively, travel to Bermuda
to teach French. There, Pierre engages in consensual unpaid sex with one of
his female students aged 17.
Paul
has sex with a 25-year old prostitute and then kills her. Pierre witnesses
the killing.
Then
they both return to Canada.
Please
analyze this scenario and discuss these questions. Do not answer simply yes
or no.
Did Pierre
commit a crime under Canadian law? If so, what crime?
Did Pierre
commit a crime under Bermuda law? If so, what crime? What is the sanction for
this crime?
Did Paul commit
a crime under Bermuda law? If so, what crime? What is the sanction for this
crime?
Can Paul be
extradited to Bermuda for the murder? Why? Why not?
Can Pierre be
extradited to Bermuda to testify as a witness? Why? Why not?
